Chattanooga surgeon, , was part of a poker game on April 13th that was raided by the police. Spitalny was testifying about the poker game and events that involved a shooting.
On the night in question, Spitalny said he heard banging at the front of the suite and shattering glass. "It sounded like the front of the building had collapsed." He said he feared the players were being robbed and he expected to be mowed down by a machine gun.
Some of the players tried to escape by running out the back of the suite and one of them - Clifford Billups - had a gun pointed at an officer that was standing backup by the rear entrance as Billups slowly began to run away from the scene. The officer shot Billups.
The good Doctor asked if he could give aid to the wounded player and was given permission, the wound wasn't life threatening.
